Legal Notice: Statutory Remedies vs. Discretionary Goodwill Policies ▼
Important Notice Regarding Recall Gaps & Dealership Goodwill Requests

Statutory vs. Discretionary Remedies: Because your vehicle model year is currently excluded from official NHTSA campaign 06V417000, authorized dealerships are not legally mandated under federal law (49 U.S.C. Section 30120) to perform free recall repairs on your vehicle.

Discretionary Goodwill Policies: The Goodwill Reference Packet generated below compiles public NHTSA safety records to assist you in requesting a voluntary, discretionary warranty adjustment from your dealership service director or manufacturer customer care division. Goodwill assistance is not an entitlement, is not guaranteed, and is granted solely at the discretion of the manufacturer and dealership based on vehicle age, mileage, and brand loyalty.

Adjacent Recall Summary (06V417000): CERTAIN VEHICLES ORIGINALLY BUILT WITH CLOTH SEATS THAT WERE EQUIPPED WITH AN AUTOMATIC AIR BAG PASSENGER SENSING SYSTEM AND LATER REUPHOLSTERED WITH AFTERMARKET LEATHER SEAT COVER KITS ARE INVOLVED. TESTING HAS INDICATED THAT THE AFTERMARKET LEATHER SEAT COVERS CAN CAUSE THE PASSENGER SENSING SYSTEM TO MALFUNCTION.

Safety Consequence: IF THE PASSENGER SENSING SYSTEM MALFUNCTIONS, THE FRONT AIR BAG ON THE PASSENGER SIDE MAY BE DISABLED WHEN IT SHOULD BE ENABLED, OR ENABLED WHEN IT SHOULD BE DISABLED. IN EITHER CASE, IN THE EVENT OF A CRASH THAT REQUIRES AIR BAG DEPLOYMENT, A FRONT PASSENGER'S LEVEL OF INJURY MAY BE INCREASED.

Manufacturer Remedy on 2006: BECAUSE A REPLACEMENT LEATHER SEAT COVER THAT IS COMPATIBLE WITH THE PASSENGER SENSING SYSTEM IS NOT AVAILABLE, GENERAL MOTORS (GM) WILL REPURCHASE THESE VEHICLES IN ACCORDANCE WITH THE TERMS STATED IN GM'S LETTER TO OWNERS. THE RECALL BEGAN ON NOVEMBER 6, 2006. OWNERS SHOULD CONTACT GM AT 1-877-477-1022 TO BEGIN THE PROCESS OF REPURCHASING THEIR VEHICLE.

ODI #10203884 • Incident Date: 09/12/2007
I RECENTLY LEASED A 2007 MALIBU. THE PASSENGER SIDE AIRBAG DOES NOT WORK WHEN A CUSHION IS PLACED ON IT TO GIVE MY WIFE THE HEIGHT SO SHE CAN SEE. APPARENTLY THE SENSORS ARE SET TO A HEAVY WEIGHT, SO IF THERE ARE SMALL PEOPLE SUCH AS CHILDREN IN THE FRONT PASSENGER SEAT THE AIRBAG SAFETY SYSTEM WILL NOT ACTIVATE IF THEY SIT ON A CUSHION. I SPOKE TO GM CUSTOMER SERVICE PEOPLE IN DETROIT, AND THEY SAID THEY HAD NEVER HEARD OF THIS. IT SEEMS TO ME THAT IN DESIGNING A SAFETY SYSTEM, CONSIDERATION SHOULD BE GIVEN TO SMALLER AND LIGHTER PEOPLE, OR HAVE A FIX AVAILABLE SO THE SYSTEM WORKS. *TR

TL*THE CONTACT OWNS A 2007 CHEVROLET MALIBU. THE CONTACT STATED THAT WHENEVER THE VEHICLE WAS DRIVEN NEAR A WIFI CONNECTION, THE AIR BAG WARNING LIGHT ILLUMINATED ON THE INSTRUMENT PANEL. THE VEHICLE WAS TAKEN TO AN AUTHORIZED DEALERSHIP WHERE THE CONTACT WAS INFORMED THAT THE FAILURE DID EXIST BUT COULD BE REPAIRED. THE FAILURE MILEAGE WAS APPROXIMATELY 21,000. THE CURRENT MILEAGE WAS APPROXIMATELY 36,000.
ODI #10442896 • Incident Date: 11/17/2010
THE AIR BAGS HAVE QUIT WORKING. THE PROBLEM SEAMS TO BE THE SAME AS THE EARLIER RECALL OF THE CADILLACS IN WHICH THE PROBLEM STARTED WITH THE PASSENGERS SIDE FRONT AIR BAG LIGHT GOING OFF AND BACK ON. *TR
ODI #10454296 • Incident Date: 03/27/2011 [CRASH]
MY VEHICLE WAS TRAVELING AT SPEED OF 35-40MPH. AT THAT TIME I WAS STRUCK FROM REAR BY ANOTHER VEHICLE. CRASH CRUSHED THE TRUNK OF MY VEHICLE UP TO BACK WINDOW. SEAT BELT DID FINE. JUST NO AIR BAG DEPLOYMENT. *TR
ODI #10458285 • Incident Date: 03/14/2012
TL* THE CONTACT OWNS A 2007 CHEVROLET MALIBU. THE CONTACT STATED THAT AS THE VEHICLE WAS STARTED, THE AIR BAG WARNING LIGHT ILLUMINATED. Adjacent Recall Summary (08V634000): GM IS RECALLING 77 MY 2009 CHEVROLET MALIBU HYBRID VEHICLES FOR FAILING TO COMPLY WITH THE REQUIREMENTS OF FEDERAL MOTOR VEHICLE SAFETY STANDARD NO. 103, "WINDSHIELD DEFROSTING AND DEFOGGING SYSTEM." THE HEATING, VENTILATION, AND AIRCONDITIONING (HVAC) SYSTEM MAY BECOME INOPERATIVE. IF THIS WERE TO OCCUR, THE BLOWER WOULD NOT FUNCTION PROPERLY AND THE MODE SELECTOR WOULD REMAIN IN THE LAST KNOWN SETTING.

Safety Consequence: IF THE WINDSHIELD BEGAN TO FOG OR FROST, THERE MAY NOT BE ENOUGH AIRFLOW TO CLEAR THE WINDSHIELD, RESULTING IN REDUCED DRIVER VISIBILITY AND A POSSIBLE CRASH WITHOUT PRIOR WARNING.

Manufacturer Remedy on 2009: DEALERS WILL REPROGRAM THE HVAC CONTROL HEAD MODULE. THE RECALL IS EXPECTED TO BEGIN ON DECEMBER 17, 2008. OWNERS MAY CONTACT CHEVROLET AT 1-800-630-2438 OR THROUGH THEIR WEBSITE AT HTTP://WWW.GMOWNERCENTER.COM .

Sample 2007 CHEVROLET MALIBU Owner Complaints (VISIBILITY)

ODI #10198172 • Incident Date: 06/20/2007
ON 7/20 MY CHEVROLET MALIBU'S SUNROOF EXPLODED. I FELT IT WAS A FLUKE OR DEFECT. I WAS DRIVING ON I-96 AND ENTERING I-94 DURING THE MORNING HEADING TOWARDS MY GRANDSON'S DAY CAMP. AFTER COMING OUT OF THE OVERPASS ENTRANCE FROM 96 TO 94, WITHIN LESS THAN A 1/4 MILE, I HEARD THIS TREMENDOUSLY LOUD SOUNDS AND GLASS BEGAN TO SHOWER ME AND MY GRANDSON CAUSING MINORS CUTS. I AM GRATEFUL I DID NOT LOSE CONTROL OF THE VEHICLE. I LEASED THIS CAR ON 6/1. IT IS LESS THAN 60 DAYS OLD. RICHARD VOSS FROM JEFFERSON CHEVROLET HAD THE GLASS REMOVED WITHOUT SO MUCH AS INDICATING TO ME THAT HE FELT SOMETHING HIT THE CAR AND WHEREAS I HAD EXPLAINED TO HIM, FROM THE DIRECTION I WAS TRAVELING, THE SPEED OF THE WIND THAT DAY, THE SOUND OF THE EXPLOSION, THE LACK OF HEARING ANY OBJECT HIT THE TOP OF THE CAR PRIOR TO THE ERUPTION, ELIMINATED MY OPPORTUNITY TO HAVE A CLAIMS ADJUSTER VIEW THE VEHICLE AND DETERMINE THE CAUSE OF THE INCIDENT. I FEEL THAT MY RIGHTS TO A FAIR DETERMINATION WERE ELIMINATED ALONG WITH THE REMOVAL OF ANY EVIDENCE TO VERIFY EITHER CLAIM AS TO WHETHER OR NOT THIS INCIDENT WAS CAUSED FROM THE PENETRATION OF A FOREIGN OBJECT OR A MANUFACTURER'S DEFECT. GLASS SHATTERED ALL OVER ME AND MY GRANDSON. WE FORTUNATE TO BE ALIVE. WE ONLY SUFFERED MINOR CUTS AND TENSION. I ONLY HOPE THAT IT IS NOT BECAUSE I LIVE IN THE CITY OF DETROIT THAT THIS CLAIM HAS NOT MERITED FURTHER INVESTIGATION; AS WELL AS A MAJOR DEALER NOT WILLING TO ASSIST IN THE REPLACEMENT OF THE BROKEN GLASS FROM THE SUNROOF. *TR
