Important Notice Regarding Recall Gaps & Dealership Goodwill Requests

Statutory vs. Discretionary Remedies: Because your vehicle model year is currently excluded from official NHTSA campaign 04V528000, authorized dealerships are not legally mandated under federal law (49 U.S.C. Section 30120) to perform free recall repairs on your vehicle.

Discretionary Goodwill Policies: The Goodwill Reference Packet generated below compiles public NHTSA safety records to assist you in requesting a voluntary, discretionary warranty adjustment from your dealership service director or manufacturer customer care division. Goodwill assistance is not an entitlement, is not guaranteed, and is granted solely at the discretion of the manufacturer and dealership based on vehicle age, mileage, and brand loyalty.

Adjacent Recall Summary (04V528000): CERTAIN PASSENGER VEHICLES FAIL TO COMPLY WITH THE REQUIREMENTS OF FEDERAL MOTOR VEHICLE SAFETY STANDARD NO. 124, 'ACCELERATOR CONTROL SYSTEMS.' IN HOT AMBIENT CONDITIONS, THE ACCELERATOR PEDAL ARM MAY STICK AT THE ATTACHMENT TO THE BRACKET AND NOT RETURN TO THE ENGINE IDLE POSITION WHEN THE OPERATOR LIFTS HIS FOOT FROM THE ACCELERATOR PEDAL.

Safety Consequence: FAILURE TO RETURN TO IDLE COULD RESULT IN A VEHICLE CRASH.

Manufacturer Remedy on 2003: DEALERS WILL INSPECT THE ACCELERATOR PEDAL ARM AND REPLACE THE ACCELERATOR AND BRAKE PEDAL ASSEMBLY WITH A NEW ASSEMBLY, IF NECESSARY. THE RECALL BEGAN ON DECEMBER 20, 2004. OWNERS SHOULD CONTACT CHEVROLET AT 1-800-630-2438, PONTIAC AT 1-800-620-7668, OR OLDSMOBILE AT 1-800-630-6537.

2001 CHEVROLET MALIBU SUDDENLY ACCELERATED WHILE THE BRAKES WERE DEPRESSED. WHILE IN PARK, THE RPMS JUMP RANDOMLY BETWEEN 500 AND 3500. WHEN PLACED INTO DRIVE THE VEHICLE WOULD GAIN SPEED TO 45-65 MPH ON FLAT GROUND WITH FOOT OFF OF BRAKE AND ACCELERATOR. REPLACED THROTTLE CONTROL SENSOR -- DIDN'T SOLVE THE ISSUE. VERY DISAPPOINTING, GIVEN THAT THE CAR WAS ALWAYS WELL MAINTAINED AND THAT I RECENTLY CHANGED TRANSMISSION OIL, SPARK PLUGS, BATTERY, FUEL PUMP, ENGINE OIL, A BUNCH OF OTHER PARTS AND STILL HAVE 3/4 TANK OF GAS... *TR

Adjacent Recall Summary (99V302000): CERTAIN PASSENGER VEHICLES FAIL TO COMPLY WITH REQUIREMENTS OF FMVSS NO. 301, "FUEL SYSTEM INTEGRITY." THE FUEL FILL FITTING IS NOT PROPERLY SECURED TO THE FUEL TANK. IN THAT CONDITION, FUEL LEAKAGE WOULD EXCEED THE PERMISSIBLE AMOUNT IN AN FMVSS TEST. FUEL LEAKS MAY OCCUR, PARTICULARLY AFTER REFUELING OR WHEN THE TANK IS MORE THAN HALF FULL.

Safety Consequence: IF AN IGNITION SOURCE WERE PRESENT, A FIRE COULD OCCUR.

Manufacturer Remedy on 2000: DEALERS WILL INSPECT THE FUEL TANK AND REPLACE IT IF NECESSARY.
